Terms of Service

By installing, signing in to, or using the PeakAI app, you agree to these Terms of Service and to the Privacy Policy. If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms of Service form a binding agreement between you and PeakAI (the operator of the PeakAI app). Your continued use of the app after a change to these Terms means you accept the updated Terms. Material changes will be communicated by an in-app notice and by email to active accounts.

2. Eligibility

• You must be at least 13 years old in most regions.
• In the European Economic Area, you must be at least 16.
• In South Korea, you must be at least 14.
• Below the local threshold, parent or guardian consent is required.
• You must be able to form a binding contract under the law of your jurisdiction.

3. Account Registration

• Provide accurate information when you sign up.
• One account per person. Do not impersonate someone else.
• You are responsible for activity under your account.
• Do not share your login credentials.
• Tell us right away if you think your account has been accessed without permission. Email support@peakai.app.

4. Use of the App

You agree not to:

• Use the app for any unlawful purpose.
• Scrape, reverse engineer, decompile, or copy the app or its data.
• Submit spam, malicious code, or fraudulent content.
• Abuse, harass, or impersonate any person.
• Try to disrupt, overload, or interfere with the service.
• Use automated tools to access the app without our written permission.
• Bypass any security or rate limiting measure.

5. Subscriptions and Billing

Some features require a paid subscription. Subscriptions are managed by the Apple App Store and Google Play.

• Pricing is shown on the App Store product page and inside the in-app paywall before you commit.
• Subscriptions auto-renew per Apple and Google defaults. You can cancel any time in your phone settings, in one tap. We never see your payment card.
• Refunds are handled by Apple and Google under their refund policies. PeakAI does not process refunds directly.
• Free trial terms vary by region and platform. Details show on the paywall before you accept the trial.
• Family Sharing on Apple covers the yearly plan for your family members on their phones at no extra cost when you set it up in the App Store.

6. Health Information Disclaimer

PeakAI is a nutrition information tool, not medical advice. The Truth Score is a personal goal-fit number, not a quality rating. Supplement information is shown for reference using the National Institutes of Health Dietary Supplement Label Database. Always consult a qualified healthcare professional for medical decisions, especially before changing your diet or starting a new supplement.

7. User Content and Feedback

• You keep ownership of any content you submit to PeakAI, including food log entries, product corrections, and feedback messages.
• You grant PeakAI a worldwide, royalty-free, non-exclusive license to use, store, and process that content to operate and improve the service.
• If you send feedback or suggestions, you let us use them to improve the product without compensation.
• Do not submit content you do not have the right to share.

8. Intellectual Property

The PeakAI name, logo, JARVIS, Truth Score, and all app content, code, design, and trademarks are the property of PeakAI or its licensors. No license is granted to you beyond using the app for its intended purpose under these Terms.

9. Third-Party Services and Data

PeakAI uses third-party services to operate, including Supabase, Apple, Google, RevenueCat, PostHog, Sentry, Anthropic, OpenAI, ElevenLabs, the USDA FoodData Central API, the NIH Dietary Supplement Label Database, and Open Food Facts. We are not responsible for the content or availability of third-party services. Their terms apply when their services are used.

10. Termination

• You may close your account at any time inside the app, or by emailing support@peakai.app.
• We may suspend or terminate your account if you violate these Terms or use the app in a way that puts the service or other users at risk. Where reasonable, we give notice. We may act without notice in cases of fraud, abuse, illegal activity, or legal requirement.
• Sections of these Terms that should reasonably survive termination, including disclaimers, limitation of liability, indemnification, and dispute resolution, survive.

11. Disclaimers

As is and as available

The app is provided on an "as is" and "as available" basis. PeakAI makes no warranty that the app will be uninterrupted, error free, or always accurate. Food and supplement data is sourced from public and third-party databases. We do not warrant the completeness or accuracy of that data.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the disclaimers above apply to the maximum extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, PeakAI and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility. Our total liability for any claim arising out of or relating to the app or these Terms is limited to the greater of: the amount you paid PeakAI in the twelve months before the claim, or one hundred United States dollars.

Some jurisdictions do not allow the limitation of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold PeakAI harmless from any claim, loss, or expense, including reasonable legal fees, arising out of your misuse of the app, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The placeholder governing law and venue here will be updated once the operating entity is registered.

15. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute between you and PeakAI arising out of or relating to the app or these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, not in court, except as set out below.

• Class action waiver. You and PeakAI agree that disputes will be resolved on an individual basis. Class actions, class arbitrations, and representative actions are not permitted.
• Small claims carve-out. Either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
• 30-day opt out. You can opt out of this arbitration agreement by sending an email to support@peakai.app with the subject "Arbitration Opt Out" within 30 days of first accepting these Terms. Include your account email.
• Injunctive relief. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for intellectual property or confidentiality matters.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by an in-app notice and an email to active accounts. The Last updated date at the top of this page reflects the most recent revision.

17. Entire Agreement

These Terms, together with the Privacy Policy and the Do Not Sell or Share My Personal Information page, are the entire agreement between you and PeakAI regarding the app. If any part of these Terms is found unenforceable, the remaining parts stay in effect.
